Maxis Executes 5G Access Agreement With DNB

Maxis, the last telco that has been delaying in accepting the terms of the 5G access agreement since it was presented has finally executed the agreement with Digital Nasional Berhad for 10 years.

In a filing to Bursa and spotted by BusinessToday, Maxis through RHB Investment Bank submitted to Bursa Securities the draft circular to shareholders in relation to the proposed transaction for clearance.

Maxis is seeking to subscribe to 5G products and services provided on a wholesale basis by DNB including the National 5G Network Product (Access Agreement).

The second largest mobile network operator will soon join CelcomDigi, Yes, and U Mobile in offering 5G speeds to its customers bringing the total available reach to full capacity in terms of user base.

Maxis was among those critical with the earlier terms offered by the national service provider under the Single Wholesale Model prescribed by the then Ministry of Finance and reluctantly accepted by the Ministry Of Communication under Minister Tan Sri Annuar Musa.

However, under Pakatan Harapan the SWN model was disregarded in favour of the Dual Wholesale Model which will now allow telecommunication players to chart their own individual journey in rolling out a 5G network.

The Access Agreement contains the terms and conditions for the 5G Products and Services, of which are mainly set out in the reference access offer published by DNB on DNB’s official website (“DNB RAO”).

These terms and conditions may be updated or replaced from time to time, amongst others, to comply with the Malaysian Communications and Multimedia Commission regulatory framework.

1/ As an access seeker, Maxis must subscribe to the National 5G Wholesale Network Product to gain access to any other 5G.

2/ Products and Services provided by DNB on the DNB network are used to provide cellular network services on a wholesale basis for 5G. The continuous range of electromagnetic wave frequencies up to and including a frequency of 420 terahertz, as defined in the Communications and Multimedia Act 1998.

3/ Maxis said it will pay the rates of the National 5G Wholesale Network Product (including any rates of such other 5G Products and Services that may be subscribed by Maxis Broadband in the future) under the Access Agreement wholly in cash and will be funded via internally generated funds and/or bank borrowings.
