PH Announced During State Election Need Not Be Paid Holiday: MOHR

During the recent heated state election, caretaker Chief Ministers in several states declared public holidays for their state residents namely states of Kedah, Kelantan, and Terengganu for 14 August 2023 (Monday) for Selangor and Negeri Sembilan.

According to the Ministry Of Human Resources, these additional public holiday has been declared under Section 9(1) of the Act Holidays 1951 [Act 369] and is not a paid public holiday that must be given accordingly section 60D(1)(b) of the Employment Act 1955 [Act 265].

However, the Ministry has encouraged employers to give public holiday pay to the workers involved.
