KPS Sued For Allegedly Not Replacing Land Taken From Owners

Kumpulan Perangsang Selangor has informed the Exchange that a writ of summon has been filed at the Shah Alam High Court against the group, Kuala Langat Land Office, and Menteri Besar Incorporated for allegedly not replacing land it took from 2 owners.

The previous owners (plaintiffs) who allegedly owned the land in Kuala Langat measured approximately 4.331 acres and another plot measuring approximately 4.875 acres which was then part of the mining scheme under KPS Berhad at Brooklyn and Sungai Kelambu, Banting, Selangor, said KPS agreed to replace the land.

The lawyers of the plaintiff said the declaration that the Land Replacement Agreement issued by 1st and 2nd Defendants (KPS and MBI) to the Plaintiffs is valid and that the defendants have breached the trust and repudiated the Land Replacement Agreement as the Defendants failed to give the replacement lands to the Plaintiffs.

The two owners are seeking damages compensation for the 2 lands based on the market rate as at the date of judgment; or in the alternative, based on the previous land assessments made by the Inland Revenue Board.

They are also seeking general damages and interest at the rate of 5% per annum on the damages compensation.

According to KPS, the plaintiffs are alleging that the Lands were previously owned by their deceased parents, namely Ang Kua and Tan Hooy, while the third plaintiff is alleging that he is the appointed administrator of the deceased parents.

They are alleging that there was an agreement that the Lands would be replaced with land located at Brooklyn, Kuala Langat. Further, it said the plaintiffs are alleging that amongst others, KPS and the group defrauded and conspired to defraud the Defendants on both Lands, resulting in the Lands being sold off to a third party.

The suit is fixed for case management on 5 December 2023 by way of e-Review before the Court Registrar. KPS Berhad said it will take all necessary steps to robustly defend the Suit and will be filing a defence to the Suit.
