Datin Seri Rosmah Mansor has been granted a conditional stay of execution on a RM67.46 million judgment obtained by Lebanese jewellery company Global Royalty Trading SAL, pending her appeal at the Court of Appeal, NST reported.
Judicial commissioner Marianne Antoinette Ghani ordered Datin Seri Rosmah Mansor to place the full RM67,461,027.37 judgment sum in a joint account held by lawyers for both parties within one month, allowing the money to remain in Malaysia while the appeal is heard.
Marianne said the arrangement would protect Global Royalty’s right to the funds if Rosmah’s appeal fails while ensuring the money could be returned to her if the appeal succeeds. Failure to comply would allow Global Royalty to begin execution proceedings.
The judge also ordered costs in the cause, meaning these will be determined as part of the appeal’s outcome.
In her judgment, Marianne said a substantial judgment sum alone did not constitute special circumstances warranting a stay. However, she found there was a real risk Rosmah could be unable to recover the money if she won the appeal, given Global Royalty’s foreign status, lack of business presence or assets in Malaysia and the absence of reciprocal enforcement arrangements.
On June 10, High Court judge Datuk Quay Chew Soon ordered the 75-year-old Rosmah to pay RM67.46 million to Global Royalty over 43 pieces of jewellery allegedly loaned to her.
The dispute involved 44 pieces of luxury jewellery worth US$14.57 million, or about RM68.3 million, which the company said were supplied to Rosmah in 2018 on a consignment basis for viewing but were never returned.
