The Kuala Lumpur High Court has granted the Securities Commission Malaysia (SC) leave to commence committal proceedings against former APL Industries Group Executive Director Tan Bee Geok for allegedly breaching the terms of a consent judgment entered into with the regulator in 2020.
High Court judge Datuk Leong Wai Hong allowed the SC’s application today, paving the way for the regulator to commence committal proceedings against Tan.
The provision relates to the communication of inside information. In the original proceedings, Tan was found to have communicated inside information concerning APL Industries Berhad to her sister, Tan Bee Hong.
Under the terms of the consent judgment, Tan agreed, among other conditions, not to act as a director of, or be involved in the management of, any public listed company (PLC) or any subsidiary of a PLC for five years from the date of the judgment.
However, the SC said Tan subsequently continued to act as a director of subsidiary companies of a PLC and remained actively involved in their management, in breach of the court-sanctioned undertaking.
The SC consequently filed an ex-parte application for leave to commence committal proceedings against Tan on Sept 17, 2025.
The High Court subsequently directed that the application be heard on an opposed ex-parte basis before allowing the SC’s application today.
