MFM Challenges MYCC’s Price Fixing Claim And RM70 Million Fine

Malaysian Flour Mills which is a joint venture partner of Dindings Poultry has challenged the Malaysian Competition Commission’s fine and claims that Dinging was involved in a price fixing scheme to raise chicken feed prices in 2022.

MyCC in its findings d alleged the company of price-fixing infringement and had imposed financial penalty of RM70 million and directed Dindings to cease and desist from participating and engaging in the anti-competitive agreement in relation to any discussion on price-related matters pertaining to poultry feed;  to submit a monthly report on changes in poultry feed prices;  to review and enhance DPDC’s existing competition law compliance training program and to enrol all employees and board members involved directly in pricing determination of poultry feed price in such program. Thereafter, a report on the enrolment in the reviewed compliance training program shall be submitted to MyCC; and to include a provision in DPDC’s Code of Conduct that the involvement of any employee or board member in any infringements against Competition Law shall amount to a misconduct and to submit the original and revised Code of Conduct to MyCC.

Malaysian Flour Mills in a Bursa filing said it strongly challenge MyCC’s finding of infringement which it said is without merit. The group said it will be consulting its external legal counsel to take the necessary and appropriate action to appeal the decision and apply for a stay of the decision in the interim.
