IRB Can Conduct Search Against Tax Defaulters Be it Individual Or Company

The Inland Revenue Board (LHDN) will use its powers in accordance with the provisions of the law if it is necessary to take search against any individual or company identified as a tax defaulter.

IRB Chief Executive Officer Datuk Dr Abu Tariq Jamaluddin said IRB has a certain method in determining companies that are delinquent in paying taxes based on studies and information received from various sources.

“For certain cases where there is a need, we use our powers to conduct searches as provided by law.

“Only cases that have been identified require us to conduct a search, but cases that have a low risk we will use auditing,” he said.

Commenting on the implementation of the electronic invoicing system (e-invoicing) pilot project, Abu Tariq said the system will be fully operational in July 2025.

During that period, he said IRB will provide all facilities to help small and medium enterprises (SMEs) including through the use of free portals in addition to providing awareness and education.

“This portal can be used by everyone, but for large companies with an income of more than RM100 million, it will start on August 1.

“These big companies have the option to develop their own system or maybe use the portal,” he said.

The e-invoicing initiative under the 12th Malaysia Plan (RMK12) was introduced in conjunction with the National e-Commerce Strategic Roadmap (NESR) 2.0 and the Digital Malaysia Catalyst Program (PEMANGKIN).

A total of 4,000 companies that earn more than RM100 million a year are targeted to be the first group to be involved in the implementation of e-invoicing which will be implemented from 1 August.

Companies with annual income or sales exceeding RM25 million and up to RM100 million will start using e-invoices on 1 Jan 2025.
