The Court of Appeal has allowed two appeals by Lim Seong Hai Capital Bhd (LSH Capital) relating to an ongoing legal dispute involving the operation of Menara Kuala Lumpur (KL Tower), paving the way for three of its subsidiaries to remain parties to the lawsuit.
LSH Capital said the Court of Appeal on Aug 10 allowed its appeal against the decision to strike out the lawsuit, as well as its appeal against the dismissal of an application to amend the proceedings.
Following the appellate court’s decisions, LSH Service Master Sdn Bhd, LSH Best Builders Sdn Bhd and Service Master (M) Sdn Bhd will remain as parties to the lawsuit.
The trial has been scheduled to take place from June 28 to July 2, 2027.
The lawsuit, filed at the Kuala Lumpur High Court involves Hydroshoppe Sdn Bhd and Menara Kuala Lumpur Sdn Bhd against the Minister of Communications, the Ministry of Communications, the Government of Malaysia, LSH Service Master, LSH Best Builders and Service Master (M).
LSH Capital said the latest development follows a series of announcements on the matter dating back to March 2025.
Separately, LSH Capital said vacant possession of Kuala Lumpur Tower was delivered by the Government of Malaysia to LSH Service Master on April 19, 2025.
Since April 26, 2025, LSH Service Master has been operating the business and managing Kuala Lumpur Tower.
The group said the ongoing lawsuit is not expected to materially affect LSH Service Master’s rights, business or operations at Kuala Lumpur Tower under the concession agreement dated March 10, 2025.
