Caretaker Government Cannot Award Tenders, Says KASA

The Ministry of Environment and Water (KASA) has referred to the statement that went viral regarding the Caretaker Government not being able to make a tender award dated Nov 7, 2022.

In accordance with the Special Meeting convened by the Ministry’s Chief Secretary and Head of Administration on Oct 11, 2022 in relation to the Circular Letter from the Ministry of Finance (MOF) dated Oct 18, 2022 on the “Implementation of Government Procurement in line with the role and function of the Caretaker Government” as well as the guidelines on the role and function played by the Caretaker Government as approved by the Cabinet of Ministers on Oct 7, 2022 which, among other things, stipulates that any contractual agreements or undertakings should be avoided, including any new negotiations or undertakings that may be binding, burdensome and have financial implications for the new Government.

During the period of a Caretaker Government, which took form after the dissolution of Parliament on Oct 10, 2022, KASA has postponed all procurement processes related to the Off-Budget Flood Mitigation Projects (2023 – 2030), including the issuance of Letters of Intent (LOI), Offer Letters, Letter of Acceptance (SST) and any form of negotiation with the contractors/consultants including work on the Langat River Flood Mitigation Plan.

KASA always observes and obeys the relevant regulations set during the period of a Caretaker Government, therefore, the statement does not arise at all and is merely perceived.
