Najib To Submit New Application For Full Royal Pardon Amid Allegations Of Procedural Irregularities

In a recent development, Tan Sri Muhammad Shafee Abdullah, lead counsel for Datuk Seri Najib Razak, announced plans to file a fresh application for a full Royal Pardon (Free Pardon) soon. This decision comes in light of allegations that the Pardons Board did not adhere to constitutional requirements during the deliberation of Najib’s previous Royal Pardon application.

Shafee highlighted concerns over the process of the Pardons Board, emphasising that the Royal Prerogative of mercy is the sole discretion of the Yang di-Pertuan Agong and should not be subject to challenge in any court. He cited inconsistencies in documents related to Najib’s case and noted that the new application would be based on sufficient grounds, including fresh arguments.

“It is unclear if the process of the Pardons Board and the decisions made to it are regular or otherwise. The law clearly states that the Royal Prerogative of mercy is the sole discretion of the Yang di-Pertuan Agong. It is unfettered and non-challengeable in any court.

“However, many public members are somewhat concerned due to the inconsistencies. My client is most baffled. As a result of these unsatisfactory features, we are looking at another application for a full Royal Pardon.

“It is unclear if the process of the Pardons Board and the decisions made to it are regular or otherwise. The law clearly states that the Royal Prerogative of mercy is the sole discretion of the Yang di-Pertuan Agong. It is unfettered and non-challengeable in any court.

“We will decide when to submit the application. We will have sufficient grounds, including some new ones,” he said during a press conference today.

Najib’s previous application for pardon was not anchored on an admission of guilt but rather on the assertion of his innocence and the claim of not receiving a fair trial, particularly at the Federal Court. Shafee criticised the court’s handling of Najib’s appeal, stating that his counsel was not given the requested adjournment, leading to proceedings without adequate submission from the defense.

Currently serving a 12-year jail term for charges related to abuse of power and criminal breach of trust involving funds from SRC International Sdn Bhd, a former subsidiary of 1Malaysia Development Bhd (1MDB), Najib has faced ongoing legal battles. Despite the recent reduction in his sentence by the Federal Territories Pardons Board, concerns over procedural irregularities persist, prompting the decision to pursue a new Royal Pardon application.

Najib’s legal team remains committed to advocating for his rights and ensuring a fair and just resolution to his legal proceedings. The outcome of the forthcoming Royal Pardon application will be closely monitored as Najib continues to navigate the complexities of his legal challenges.
