Federal Court Grants Leave In Lim Seong Hai’s Lake Side Homes Legal Dispute

The Federal Court has granted leave to appeal in an ongoing judicial review involving Lim Seong Hai Capital Bhd’s Lake Side Homes development project, paving the way for a hearing on a Court of Appeal discovery ruling.

The group said the Federal Court allowed separate motions for leave filed by Kuala Lumpur City Hall (DBKL), represented by the Datuk Bandar Kuala Lumpur, and Astana Setia & Euro Saga Sdn Bhd (ASES).

The appeals challenge an earlier Court of Appeal decision relating to the discovery process in a judicial review application brought by six applicants, led by Chin Tong Lim, against DBKL and ASES.

The Federal Court will now hear the appeals on a date to be fixed.

The company noted that the latest court decision does not affect the ongoing implementation of the Lake Side Homes project.

Pending the courts’ final determination of the judicial review application, ASES remains permitted to continue construction works on the Lake Side Homes development under the disputed Development Order and Bridge Approval that have been in effect since Aug 21, 2024.

The judicial review was initiated by the applicants seeking to challenge approvals granted by DBKL in relation to the development project.
