Mah Sing Group Bhd said its wholly-owned subsidiary, Elite Park Development Sdn Bhd, has lost a High Court civil suit involving alleged professional negligence, with the court dismissing its claims against three defendants and ordering the company to pay RM1.65 million in legal costs.
The developer said the High Court delivered its decision on July 24, dismissing the plaintiff’s claims against Zulhkiple Abu Bakar, who practises under Perunding ZNA, and two other defendants.
The court also allowed the first defendant’s counterclaim of RM114,088.23, together with interest at 5% per annum from May 23, 2019 until full settlement.
In addition, Elite Park Development was ordered to pay a total of RM1.65 million in legal costs to all three defendants.
The case dates back to 2019, when Elite Park Development commenced legal proceedings against the defendants, alleging professional negligence and claiming damages amounting to approximately RM47 million, according to the company’s earlier announcements.
Mah Sing said the financial impact arising from the High Court’s decision is expected to be limited to the judgment sum of RM114,088.23, the RM1.65 million legal costs awarded to the defendants and the associated interest payable.
