Mudajaya Group Berhad said a long-running legal dispute involving its wholly owned subsidiary has been remitted to the High Court for a full trial following a ruling by the Court of Appeal.
The group said the civil suit was initiated by Mudajaya Corporation Berhad against Crest Worldwide Resources Sdn Bhd, seeking among other reliefs an order for specific performance.
The case concerns the delivery of vacant possession of a portfolio of assets comprising 25 residential apartments, five commercial shop units, 142 office units, 284 car park lots and 99 motorcycle parking bays under various sale and purchase agreements.
Crest Worldwide had appealed against the High Court’s decision dated Oct 22, 2025. The appeal was heard on May 5, 2026.
The Court of Appeal ruled that the trial judge had erred on procedural grounds in directing a preliminary determination of the matter under Order 33 of the Rules of Court 2012, holding that the issues involved disputed facts that should instead be examined in a full trial.
As a result, the appellate court ordered the case to be sent back to the High Court.
The Court of Appeal also awarded RM20,000 in costs to Crest Worldwide. In addition, the RM100,000 costs previously awarded by the High Court and already paid by Crest Worldwide to Mudajaya Corporation must now be refunded.
Mudajaya said there are no further financial implications arising from the latest court decision at this stage.
