SkyGate Solutions Bhd said its subsidiary, SkyGate Integration Sdn Bhd (SISB), has been served with a lawsuit by Carsem (M) Sdn Bhd over an allegedly defective overhead conveyor system, with claims exceeding RM2.42 million excluding damages, interest and legal costs.
The group said SISB received a writ of summons and statement of claim issued by the High Court of Malaya in Ipoh on July 31. The legal action was initiated by Carsem on July 23.
SkyGate said the dispute centres on allegations that SISB failed to exercise reasonable skill, care and diligence in the design and implementation of the overhead conveyor system.
According to Carsem’s claim, the completed system was not fit for its intended purpose and failed to operate despite testing. The plaintiff further alleged that SISB did not rectify or resolve the issues identified during commissioning.
The company said SISB intends to contest the claims and that it will take all necessary steps to protect the interests of the group.
SkyGate said, apart from legal costs associated with defending the case, the lawsuit is not expected to have any material impact on the group’s earnings, net assets, gearing or share capital for the financial year ending Dec 31, 2026.
