AuMAS Says Mining Operations Unaffected After Court Sets Aside Southsea Gold Injunction

AuMAS Resources Bhd said its mining and processing operations remain unaffected after the court set aside an ex-parte injunction previously obtained by Southsea Gold Sdn Bhd (SGSB) against its wholly owned subsidiary, Wullersdorf Resources Sdn Bhd (WRSB), as legal proceedings between the parties continue.

In a Bursa Malaysia filing, AuMAS said the court on Sept 3 allowed WRSB’s application to set aside the ex-parte injunction that SGSB had obtained on Aug 14.

At the same proceeding, however, the court granted SGSB a limited ad interim injunction pending an inter-partes hearing or further order of the court.

Under the interim order, WRSB is restrained from causing, permitting or allowing contaminated water originating from the Tailings Storage Facility (TSF) to escape, seep, flow or be discharged beyond the boundary of the sub-leased land onto other parts of the main lease land or into any watercourse connected with it.

AuMAS stressed that the order does not prevent WRSB from undertaking inspection, emergency containment, sampling, monitoring, pumping, treatment, neutralisation, repair or remediation works, subject to the terms of the injunction and directions from the relevant authorities.

The court also ordered that the limited injunction does not alter or suspend earlier court orders.

SGSB is similarly prohibited from interfering with WRSB’s access or genuine inspection, containment, repair and remediation activities protected under those earlier orders.

The inter-partes hearing for SGSB’s ad interim injunction has been fixed for Oct 8, 2026.

Separately, AuMAS said a third injunction previously obtained by the company is due to expire on Sept 4, pending the court’s decision on its inter-partes hearing and SGSB’s application to set it aside.

AuMAS and WRSB have applied for an ad interim injunction to preserve the relevant protections until the court delivers its decision on Oct 16, 2026.

That application remained pending before the court as at the date of the announcement.

The latest developments follow AuMAS’ earlier announcements on Aug 17 and Aug 28 concerning the ongoing proceedings involving the company, WRSB and SGSB.

AuMAS said the legal developments are not presently expected to have any material operational impact on the group, including WRSB’s ongoing mining and processing activities.

The company also does not currently expect the proceedings to have a material financial impact on its earnings, net assets or gearing for the financial year ending Sept 30, 2026.

AuMAS said it would make further announcements should there be any material developments in the proceedings.
