Former Prime Minister Datuk Seri Najib Razak and his son Datuk Mohd Nazifuddin have succeeded in their bid to suspend bankruptcy proceedings linked to tax arrears of RM1.7 billion and RM37.6 million respectively, according to TV3.
A three-member Court of Appeal panel unanimously allowed their appeals today, ruling that the issues raised before the Special Commissioners of Income Tax (SCIT) were sufficiently serious to warrant a stay of the bankruptcy proceedings.
The panel, chaired by Datuk Dr Alwi Abdul Wahab and comprising Datuk Dr Shahnaz Sulaiman and Datuk Ong Chee Kwan, also set aside the Kuala Lumpur High Court’s decision on 17 November 2025 which had rejected their applications for a stay.
The applications were made pending the outcome of their appeals before the SCIT, where both are challenging additional tax assessments issued by the Inland Revenue Board (IRB).
The Court of Appeal’s decision allows the bankruptcy proceedings to be suspended while the tax appeals are resolved before the SCIT.
