IHH Healthcare Bhd has filed an appeal with the Tokyo High Court against a judgment issued by the Tokyo District Court on Sept 10, 2026, in a legal dispute linked to its acquisition of India’s Fortis Healthcare.
In a statement, IHH said its indirect wholly-owned subsidiary, Northern TK Venture Pte Ltd (NTK), decided to seek appellate review after assessing the judgment.
The healthcare group maintains that it suffered losses arising from delays in obtaining mandatory tender offer approvals for its Fortis acquisition. It said the delays occurred in the context of a dispute between Daiichi Sankyo and certain judgment debtors, to which IHH was not a party.
IHH reiterated that its acquisition of Fortis in 2018 was conducted through a publicly disclosed and regulated process, with the necessary corporate, shareholder and regulatory approvals, including those required by the Competition Commission of India and under the Securities and Exchange Board of India’s takeover regulations.
Despite the ongoing legal proceedings, IHH reaffirmed India as a key strategic market and outlined plans to deepen its investments in the country.
Over the next three to five years, the group intends to increase its stake in Fortis Healthcare to 51% and further integrate its Fortis and Gleneagles hospital platforms.
IHH also aims to expand its healthcare capacity in India to approximately 10,000 beds by 2031, positioning the group to meet growing demand for private healthcare services.
The group said it remains committed to expanding its presence in India through sustained investment and closer integration of its hospital operations.
