Separation Of AG And Public Prosecutor Roles To Be Tabled In This Sitting, Says Fahmi

The proposed separation of the roles and powers of the Attorney General (AG) and the Public Prosecutor will be tabled during the current Parliament sitting, Communications Minister Fahmi Fadzil said.

Fahmi said the move forms part of the government’s efforts to strengthen institutional reforms and enhance the integrity, independence and transparency of Malaysia’s legal system.

The separation of the two roles has been a long-standing governance issue, with discussions centred on ensuring a clearer distinction between the AG’s responsibilities as the government’s legal adviser and the Public Prosecutor’s authority in making prosecution decisions.

Currently, both positions are held by the same office under Article 145 of the Federal Constitution, where the Attorney General also serves as the Public Prosecutor.

Fahmi said details of the proposed amendments and the government’s approach would be presented when the matter is tabled in Parliament.

The reform is expected to be closely watched as it involves constitutional considerations and could have implications for Malaysia’s justice and accountability framework.
